These Terms of Use govern your use of the Filipino Movie Rentals service and Web site. These Terms of Use affect your rights and you should read them carefully. By using, visiting, or browsing the Filipino Movie Rentals Web site, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the Filipino Movie Rentals service or Web site.

Filipino Movie Rental’s personal information practices on this Site are governed by Higante Works, Ltd. Co.’s privacy statement. Please review this Privacy Statement and print a copy for your records.

Limitations on Use
You must be 18 years of age or older to subscribe to the Filipino Movie Rentals service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. Any unauthorized use of the Filipino Movie Rentals Web site or its contents will terminate the limited license granted by us.

Membership and Billing
By using the Filipino Movie Rentals service, you are expressly agreeing that we are permitted to bill you a monthly subscription fee, any applicable tax and any other charges you may incur in connection with your use of the Filipino Movie Rentals service. Additional charges may include gift subscription purchases you make, movies you fail to return or service level changes you request.

Automatic Renewal
The subscription fee will be billed at the beginning of your subscription and on each monthly renewal thereafter unless and until you cancel your membership. All fees and charges are nonrefundable. Your Filipino Movie Rentals subscription will be automatically renewed on a monthly basis. For your convenience, we will bill the monthly subscription fee plus any applicable tax to the Payment Method you provide to us during registration. Your membership will automatically renew for successive monthly subscriptions, without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership at least five (5) business days before it renews each month in order to avoid billing of the next month's subscription fees to your Payment Method.

We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by e-mail. If your Payment Method reaches its expiration date, your continued use of the service constitutes your authorization for us to continue billing that Payment Method.

Cancellations
You may cancel your subscription to Filipino Movie Rentals at anytime. To cancel, click the word "Cancel Membership" on the "Your Account" page and follow the instructions for cancellation under the heading "Cancel Membership." WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY UNUSED SUBSCRIPTIONS, PARTIAL-MONTH SUBSCRIPTION PERIODS OR UNWATCHED MOVIES. You must cancel your membership at least five (5) business days before it renews each month in order to avoid billing of the next month's subscription fees to your Payment Method. Upon cancellation, you will be given seven (7) days to return any outstanding rentals. Failure to return such rentals will result in your Payment Method being automatically billed the MSRP of the discs. Billed DVDs received by Filipino Movie Rentals within thirty (30) days from cancellation date may be refunded subject to a $9.95 restocking fee.

We reserve the right to terminate your account for any or no reason.

Account Access and Identity Protection
You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account. You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. If you decide to share your account with other people, you take full responsibility for their actions. Users of public or shared computers should log out at the completion of each visit to the Filipino Movie Rentals Web site.

Filipino Movie Rentals is not obligated to credit or discount a membership for holds placed on the account by either a representative of Filipino Movie Rentals or by the automated processes of Filipino Movie Rentals.

Electronic Communications
By using the Filipino Movie Rentals service, you consent to receiving electronic communications from Filipino Movie Rentals. These communications will include notices about your account and information concerning or related to our service. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

How the Filipino Movie Rentals Service Works
We provide a number of different subscription plans to accommodate a variety of movie watching preferences. The number of DVDs that you rent will vary based on a number of factors. Most of our subscribers rent between 3-11 movies per month.

Delivery Times
The large majority of our subscribers are able to receive their movies in about two to four business days following our shipment of the requested movie. The delivery times you encounter will vary based on a number of factors.

Other factors that may affect delivery times, include, but are not limited to, (i) the distance between the distribution center and your delivery address, (ii) the timing of your placement or adjustment of movies in your queue and (iii) circumstances impacting delivery by the U.S. Postal Service.

We will send you an e-mail letting you know when we have received a returned movie, and we will also send you another e-mail letting you know when we have shipped your next DVD, including the anticipated time of delivery.

No Due Dates No Late Fees
Provided you continue to be a paying subscriber of our service, you may keep the DVDs delivered to you as long as you like. We do not impose any required return dates (other than upon cancellation of the service).We do not charge any late fees. You will be required to return the movies within seven (7) days following any cancellation of the service or be subject to charge for unreturned DVDs. Also, you may be charged for movies that you lose.

Lost DVDs
As an additional member benefit, we will replace the occasional lost DVD free of charge.
However, in the rare event that the number of lost DVDs on your account becomes excessive, as we may determine in our sole and absolute discretion, we will notify you that your account has been placed on hold for review and may charge your Payment Method for the estimated cost of the lost DVD(s). We will alert you of any potential charges prior to charging your Payment Method.

In the event that a DVD was not received, you have 15 days from its expected date of delivery to submit a lost report. Lost Reports must be submitted using our online problem reporting tool by logging in to your account and clicking on the SUBMIT PROBLEM REPORT link under the MY ACCOUNTS page. Failure to do so will result in your Payment Method being billed the MSRP of the discs.

Your Queue
Movies that you select to rent will be placed into your own rental queue. You may add movies or adjust the queue at anytime. It is your responsibilty to maintain at least 10 movies in your queue at all times. We will determine which movies to send you based on the movies in your queue and the priority in which you have listed them. We endeavor to ship to you the movies listed highest in your queue; however when availability is limited, we may ship you movies lower on your queue. Adjustments made to your queue may not immediately impact your next shipment. In certain instances you may have adjusted your queue before you have received a shipment message when in fact a shipment was already processed. The adjustments will, however, impact subsequent shipments.

Plans
Subcriber may change plans at any time. Upgrades in plans will result in billing the difference of the plans. Downgrades in plans will affect the next billing cycle. No refunds for partial months of use will be credited. Future billing cycles will be billed at the new rate.

Delivery and Return of Rentel DVDs
We reserve the right to allocate and ship DVDs to you in any manner that we, in our sole and absolute discretion, determine. In addition, we will, in our sole and absolute discretion, determine the quantity of DVDs we purchase for any particular title and the number of shipments to be processed. As a result, we may not always send you the first choice from your queue. In most instances, your next available DVD will not ship until the next business day following our receipt of your returned movie. This can occur when your top choices are not available to you or the number of shipments to be processed on that day has been exceeded.

We do not process returns or deliveries on Saturdays, Sundays or Holidays.

Damaged Discs
Our discs are sent and returned with a plastic protective casing that makes the disc virtually protected from potential damages that would make the disc unusable. It is the member’s responsibility to return all media to Filipino Movie Rentals in substantially the same condition as it was received by the member, normal wear and tear expected. If a media is returned to Filipino Movie Rentals in a substantially worse condition than it was received by the member, and the media is unplayable, we may place the member’s account on shipping hold and charge the member a replacement fee of $29.95 per disc. If we deem that there has been excessive breakage related to a customer’s account, we reserve the right to cancel that account in our sole and exclusive discretion.

Discs returned with damaged or without the plastic protective casing are charged to your account at $2.95 per casing.

Billing Disputes
Purchases from FilipinoMovieRentals.com will appear on your statement as "Higante Works, Ltd. Co.". As a customer of FilipinoMovieRentals.com, you agree to allow Megastar Home Entertainment (parent company) to attempt settlement of any billing dispute for 30 days before disputing with any third party, credit card company or bank. Higante Works, Ltd. Co. simply requires that it be the first option in billing disputes. Should Megastar Home Entertainment receive an invalid chargeback, or a chargeback or other reversed charge from a third party, credit card company or bank on your behalf before Higante Works, Ltd. Co. has been given a chance to resolve the issue, Higante Works, Ltd. Co. has the right to collect on the rendered services and any fees associated with those disputes. Higante Works, Ltd. Co. charges a $25.00 Chargeback Fee per chargeback should a credit card company be used as a first resort in a billing dispute, or if a chargeback is found to be invalid. As a customer of FilipinoMovieRentals.com, you agree to these Terms.

Refunds and Chargebacks
All sales are final. We do not provide refunds or credits for any unused subscriptions, partial-month subscriptions periods or unwatched movies. You agree not to dispute, reverse or chargeback any legitimate payments to us until you contact us to try and resolve your dispute. If you are dissatisfied with our services or any Filipino Movie Rentals product you have purchased using your credit card you must follow the return/refund policy and procedures set forth under this Terms of Use Agreement. In the event you breach this term and you charge back your credit card for all or partial amounts within your account, we will dispute the chargeback if we feel your claim is without merit. If we are called to defend against a chargeback initiated by you or your authorized agent, you will be charged an administrative service fee of one hundred ($150) dollars, which you agree to pay in addition to the amount of the subscription fee and other fees you owed to the date of the chargeback.

Credit Card Fraud
Submission of credit card information to Filipino Movie Rentals and its online transaction processor is equivalent to a legal signature; and all IP addresses and user access logs to the website will be retained to verify users' identities. Fraudulent use of credit cards can and will be prosecuted to the full extent of all applicable laws. Fraudulent use includes entering false credit card information and obtaining chargebacks when the credit card has NOT been stolen and the transaction has NOT been an error. Any member obtaining a chargeback through fraudulent means will be fined the maximum penalty allowable by law.

Credit card users may be subject to a preauthorization. The preauthorization is not a charge to the credit card. However, the then applicable monthly subscription charge may be reserved against the Member's available credit card limit. Filipino Movie Rentals will not be held responsible for bank charges, fees or penalties due to overdrawn or delinquent Subscriber accounts. Contact your credit card issuing financial institution for details.

Miscellaneous
Users may not use FilipinoMovieRentals.com to send unsolicited advertising, promotional material, or other forms of solicitation to other Users except in those specified areas that are designated for such a purpose.

It is a crime to use a false name or a known invalid credit card to purchase a subscription or to cancel a credit card without returning the property of Filipino Movie Rentals. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted. Each electronic entry carries the computer coding of the Internet provider through which the individual User can be traced.

Warranties and Limitations on Liability
The Filipino Movie Rentals service assume no liability or responsibility for any errors or omissions in the content of the Filipino Movie Rentals Web site, any failures, delays, or interruptions in the shipment of DVDs, delivery of any content contained on the Filipino Movie Rentals Web site, any losses or damages arising from the use of the content provided on the Filipino Movie Rentals Web site, or any conduct by users of the Filipino Movie Rentals service or Web site. We make no representations or warranties of any kind with respect to the Filipino Movie Rentals Web site, its contents or our service. We disclaim all representations and warranties, including, warranties of merchantability, fitness for a particular purpose, and non-infringement.
